Council tax is a local charge that helps fund services such as rubbish collection, policing, schools, and libraries. But when it comes to rented property — who actually pays it: the tenant or the landlord? Here’s everything you need to know.

Who Is Responsible for Paying Council Tax?

In most standard tenancy agreements, the tenant is responsible for paying council tax directly to the local authority. This is the case for:

  • Assured shorthold tenancies (ASTs)

  • Private single-tenant lets

  • Couples or families renting an entire property

When Is the Landlord Responsible for Council Tax?

Landlords may be liable for council tax in specific scenarios:

  • During void periods when the property is vacant

  • If the property is a House in Multiple Occupation (HMO)

  • When the landlord includes council tax within a bills-inclusive rent

  • For holiday lets or serviced accommodation

What About HMOs and Shared Houses?

In licensed HMOs or student houses where tenants rent individual rooms on separate agreements, the landlord is usually responsible for paying council tax – and may include it in the rent.

Do Students Pay Council Tax?

Full-time students are exempt from council tax. If a property is fully occupied by students, no council tax is due. Mixed households (students + professionals) may receive a partial bill.
